General Terms and Conditions of Hospitality Services

These General Terms and Conditions of Hospitality Services ("Terms and Conditions") govern contracts for hospitality services (hotel accommodation services) concluded through:

  • by e-mail: kaj@salveregina.hr

including direct enquiries and any other communication channels (collectively referred to as the Platform), between SALVE REGINA – MARIJA BISTRICA d.o.o. (hereinafter referred to as Hotel Kaj or the Service Provider) and customers who are natural persons over the age of 18 booking accommodation for private purposes.

These General Terms and Conditions contain all pre-contractual information required under the Croatian Consumer Protection Act as well as commercial information required under the Croatian Electronic Commerce Act.

Please read these Terms and Conditions carefully.

If you do not agree with these Terms and Conditions, you must not make reservations or purchase hospitality services through the Platform.

By using the Platform, you confirm that:

  • you are at least 18 years of age
  •  you have read and understood these Terms and Conditions in full
  • you accept all rights and obligations contained herein
  • you agree that these Terms and Conditions apply to you in their entirety

(hereinafter referred to as Hotel Kaj)

Inspection of compliance with the Croatian Act on the Provision of Tourism Services is carried out by the State Inspectorate of the Republic of Croatia through authorised tourism inspectors.

SALVE REGINA – MARIJA BISTRICA d.o.o. acts as the accommodation provider for Hotel Kaj, which is owned and operated by the company.

These General Terms and Conditions form an integral part of every accommodation contract concluded between the guest and the accommodation provider.

SALVE REGINA – MARIJA BISTRICA d.o.o., as the owner and operator of the Platform, is responsible for the operation of the Platform and does not charge any booking fee for reservations made through it.

All accommodation providers available through the Platform are considered traders within the meaning of the Croatian Consumer Protection Act.

 

Important Notice

Where package travel arrangements are purchased, the organiser's specific General Terms and Conditions and pre-contractual information shall apply.

These Terms and Conditions shall apply only to the extent that they are not superseded by the organiser's package travel conditions.

Hotel Kaj is owned and operated by SALVE REGINA – MARIJA BISTRICA d.o.o.

Users of the Hotel Kaj website are also required to comply with the Website Terms of Use.

These Terms and Conditions apply exclusively to accommodation contracts concluded through the Platform for private purposes.

Accommodation Information

Descriptions of accommodation units are available on the website.

Photographs are provided for illustrative purposes only.

Although every effort is made to ensure that photographs accurately represent the accommodation, minor differences between the photographs and the actual accommodation unit may occur.

Information regarding the type of accommodation and services included is displayed together with each accommodation offer.

SALVE REGINA – MARIJA BISTRICA d.o.o. reserves the right to withdraw any accommodation or hospitality service from sale at any time without prior notice.

Reservations

A reservation means a confirmed booking of accommodation at Hotel Kaj that includes an obligation to pay, regardless of the selected rate or the agreed payment date.

By confirming a reservation, the customer concludes a distance contract for hospitality services (hotel accommodation services) with the accommodation provider.

The accommodation contract consists of:

these General Terms and Conditions;

the specific booking conditions displayed during the reservation process, including, but not limited to, the room description, accommodation type, services included, reservation dates, number of guests and selected rate.

Alternative Accommodation

In the event of overbooking or any other circumstance that prevents the accommodation provider from providing the reserved accommodation (for example, if the accommodation cannot be made available for operational reasons), the accommodation provider reserves the right to accommodate the guest in another property of the same or a higher category at no additional cost.

In such cases, the guest shall not be entitled to claim compensation solely due to the change of accommodation.

Reservation Cancellation

Guests may cancel their reservation in accordance with the cancellation policy applicable to the selected rate.

In accordance with Article 79 of the Croatian Consumer Protection Act, customers do not have the statutory right to withdraw from a distance contract for accommodation services where the accommodation is provided for purposes other than residential use and the contract specifies a particular date or period of performance.

The Privacy Policy also contains contact details for enquiries relating to the processing of personal data and the exercise of data protection rights.

Complaints

The contracting parties shall endeavour to resolve any dispute amicably.

Guests are encouraged to contact Hotel Kaj directly in the first instance so that any issue may be resolved as quickly and efficiently as possible.

Complaints relating specifically to accommodation services may also be submitted directly to the accommodation provider.

Applicable Law and Jurisdiction

These Terms and Conditions, the Platform and all accommodation contracts concluded through the Platform shall be governed by the laws of the Republic of Croatia.

Any disputes arising from or in connection with these Terms and Conditions or accommodation services shall be subject to the exclusive jurisdiction of the competent court in Zagreb, Croatia.

Online Dispute Resolution

Consumers residing within the European Union may use the European Commission's Online Dispute Resolution (ODR) platform in accordance with Regulation (EU) No. 524/2013.

The ODR platform provides consumers and traders with an alternative method of resolving disputes arising from online purchases without the need to initiate court proceedings.

Amendments to the Terms and Conditions

SALVE REGINA – MARIJA BISTRICA d.o.o. reserves the right to amend these General Terms and Conditions at any time without prior notice.

The current version will always be published on the Hotel Kaj website together with the date on which it enters into force.

Any amendments shall apply only to reservations made after the revised Terms and Conditions have been published.
